Mexican court ruling does not free suspect in U.S. journalist's death

Juan Manuel Martínez Morena was arrested last year in connection with the 2006 killing of video journalist Brad Will during a protest in Oaxaca state. A federal judge ordered the suspect’s release, saying prosecutors lacked enough evidence to hold him, EFE and Milenio report.

The ruling asked for him to be released in 48 hours, saying the evidence in the case was “prefabricated” and lacked a legal foundation.

Martínez may not be freed right away until all pending court actions are decided, Proceso adds.

UPDATE:
The Committee to Protect Journalists (CPJ) says that contrary to initial reports from EFE and Milenio, the court's decision did not call for Martínez's release. The defendant's lawyer says a Nov. 19 hearing will decide Martínez's status and that the ruling only declared new evidence from the prosecution inadmissible.
